These Terms and Conditions set out our conditions for you using the Site and any material on it. You must agree to these Terms and Conditions to use this Site. If you do not agree to these Terms and Conditions, do not use the Site.

An age restriction, to users 18 years or over, is applied as a condition of accessing this Site. Do not access this Site if you are under the age of 18. You have to register with us. If you are under 18, do not attempt to register. You must keep your personal information accurate and up to date, especially your email address.

  1. All intellectual property rights in the Site, content on the Site (“the Archive”) or accessed as part of the Site and any database in relation to it operated by us belong to us or has been licensed to us. You are not allowed to copy, reproduce, redistribute, download or use the Site, the Archive or any part of it other than as permitted here. All rights are reserved.
  2. Access to the content on the Site is only permitted by Authorised Users. An “Authorised User” is any person, 18 years or over, who has the express permission of the University of Bristol to access the Archive and use it solely for the Permitted Purpose. The “Permitted Purpose” means private educational, research and private study purposes. The Frequently Asked Questions and Answers listed below may assist you in interpreting these Terms and Conditions.
  3. The University does not warrant that the Archive content will not infringe the rights of third parties. For example, some works may be under copyright by an author, photographer or an artist or their heirs holding rights to these works. Such works may not be used in any form; they may not be copied or downloaded without prior permission from the holder of the underlying copyright.
  4. Using the Archive outside the Permitted Purpose is prohibited. For the avoidance of doubt, copying or redistribution in any manner for commercial use, including without limitation, commercial publication, or for personal gain is strictly prohibited.
  5. Every effort has been made to contact the copyright holders for material included in the Site. However, if you believe that you own the copyright in any of the content on the Site, and we have not recognised you as a copyright owner, please contact us and we will investigate quickly. While we are investigating, we may temporarily remove the content in question. If we agree that you are a copyright owner, we will work with you to find a solution that you agree upon, or we will take the relevant content in question off the Site permanently.
  6. Without limiting the foregoing, all Site content is provided "as is" without a warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular use, and/or non-infringement. The University assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your use of the Site or your downloading of any content from the Site.
  7. The University has not reviewed all of the webpages or websites linked to the Site and is not responsible for the content of any off-site pages or other sites linked to the Site. Accessing or linking to any off-site pages or other sites is entirely at your own risk.
  8. You may only publish content that you own the copyright in (or have permission to publish it from the copyright owner) on the Site. Anything that you upload to the Site may not include anything we consider offensive, inappropriate or defamatory (this is at our discretion); unlawful (for example by saying something defamatory) or share the personal information of living people without their permission. You are responsible for managing content you create, including using privacy settings we make available. You will compensate us fully for any losses, damages, liability, costs or expenses we incur as a result of a breach by you of this Condition.
  9. You retain ownership of the copyright in any content that you publish on the Site, but by publishing it on the Site you grant us and all persons accessing the Site from time to time irrevocable permission to use, copy reproduce and publish it for any purpose connected to the Site and the Permitted Purpose and to edit, adapt or modify it as we wish. In uploading your material to the Site you irrevocably waive all moral rights to which you may now or in the future be entitled in respect of the material that you create or publish on the Site. If we use any of your personal information (for example your name) in connection with it, we will ask your permission first.
  10. We do not monitor user generated content published on the Site and take no responsibility for things that you publish. If you see something on the Site that you think is offensive, unlawful, illegal or which is not in line with these Terms and Conditions, please let us know. We do not guarantee that we will always remove it, but we will certainly look into it. We reserve the right to remove content that you create from the Site at our sole discretion.
  11. If you breach these Terms and Conditions, we reserve the right to stop you using the Site.
  12. The availability of the Site and/or Archive is not guaranteed. The Site and Archive are provided on an “as is” basis and are subject to change. We do not warrant or promise that the Site will always be available or fully functional and reserve the right to withdraw the Site or any part thereof or any content at any time and will not be liable to you for any losses you might suffer.
  13. In the event we are notified that any of the material featured on the Site (whether Archive material or user generated content) potentially infringes the rights of any third party, we reserve the right to remove that content. The content will remain removed until we have conducted our investigation and may be permanently removed depending on the outcome of our investigation.
  14. Liability: The only warranties or promises we give are set out in these Terms and Conditions and in so far as we are permitted to do so by law, all warranties in respect of the Site and the Archive and any other content are excluded. We cannot accept liability for any indirect or consequential losses, loss of data or any use of content you suffer from using the Site, although we do not limit liability for personal injury or death caused by our negligence or fraud.
  15. Assignment: These Terms and Conditions are personal to you, and you are not allowed to transfer your rights under this agreement to anyone else.
  16. Severance: If any part of these Terms and Conditions no longer applies or is no longer legally enforceable, then that part will be severed from the rest of the agreement and the rest will continue to apply.
  17. These Terms and Conditions are made under English law, and any arguments about them will only be heard in English courts.
  18. The University may at any time revise these Terms and Conditions.
